A panel headed by Lt. Gov. Gavin Newsome has released a report urging California legislators and voters to proceed cautiously with legalization of marijuana for recreation.

The Blue Ribbon Commission on Marijuana Policy, which was founded two years ago, outlines a total of 58 strategies, goals and recommendations for marijuana legalization that focus on limiting access to young people, offering sufficient treatment programs and public education campaigns.

The underlying theme throughout the report was that heavy government regulation is key to the process, and several suggestions were made on engaging the federal government to, at minimum, relax the banking standards and IRS rules that currently block these types of businesses.

In 1996, California led the way in medical marijuana legalization. This was a very big step, and it was done at a time when the federal government and the United States Drug Enforcement Agency (DEA) had every intention of arresting and prosecuting even the sickest of medical marijuana patients for doing something that was legal under California state law.

ballot.jpgNot only were DEA agents going after patients and dispensary owners, the Federal Depositors Insurance Corporation (FDIC), and other federal banking oversight agencies were going after any banks that allowed medical cannabis dispensary owners to hold accounts at their respective banks, since they considered all this money proceeds from an illegal enterprise. The IRS was also going after people for claiming, or not claiming, what they considered illegal income on tax documents.

According to a recent news article from the Los Angeles Times, the shifting attitudes and relaxation toward marijuana use has gone a long way in removing the stigma long associated with marijuana use.

This was not just some, but all sellers of marijuana. Parents would routinely warn children to stay away from anyone selling marijuana, and people would talk about how the drug was destroying the community and robbing it of its values.

As a number of states have opened the doors to the cultivation, manufacture and distribution of hemp and related products, a number of industry advocates have released a series of guidelines for best practices in order to ensure both quality of the product and consumer safety. hempfarm.jpg

The recommendations were made as part of a collaboration between the Hemp Industries Association, Americans for Safe Access, the Cannabis Committee and the American Herbal Products Association. The guidelines were submitted after input from a number of industry experts, and were presented at the National Medical Cannabis Unity Conference last month in Washington, D.C.

According to a February 2015 report by the Congressional Research Service, noted that while precise data is not available for the size of the hemp-based product market in the U.S., it’s estimated to be somewhere around $580 million. It’s a commodity that’s cultivated for use in a wide range of products, which includes food and beverages, cosmetics, personal care products, nutritional supplements, textiles and fabrics, insulation and construction materials and other manufactured goods.

Those who rely on medicinal marijuana for treatment of severe illnesses and medical conditions fear that the expansion of recreational marijuana may harm their chances for safe access. handsholding.jpg

An example of this was recently outlined by the Cincinnati Enquirer, which is chronicling the process of marijuana legalization in Ohio.

There are currently 23 states that allow marijuana as medicine, and another four states that have granted permission for recreational use and sales. States that are weighing which path they want to take have been given little direction by the federal government on the issue, other than the necessity of a strong legal framework of checks and balances to ensure the drugs aren’t sold on the black market or to children.

It’s been nearly two decades since California voters approved the use of medical marijuana. Yet many cities quickly or over the course of the years enacted local bans on cultivation and dispensing, opening those with legitimate need and good motives to the possibility of criminal prosecution, eviction and civil forfeiture.

San Diego was one of those. But now, the city has allowed its first permitted medical marijuana dispensary, in a strip mall situated near the internal border. The lines were modest, though those who waited expressed relief they could finally purchase their medication from an approved shop in the city for the very first time. Customers said with other locations, there was always the concern the facility would be raided.

The new measure that permits medical marijuana dispensaries within city limits requires the facilities to be non-profit operations. They must allow testing of their products, and there needs to be adherence to strict zoning requirements and tight security rules. The process allows a path to legitimacy for the existing underground operations. About 50 other cities in the state have gone the same route.

Nationwide, parents, medical experts, researchers, and activists have pushed for reform to help children with epilepsy gain access to medical marijuana. In an attention grabbing twist before the General Assembly, a child who was present to lobby in favor of medical marijuana testing had a seizure. According to local reports, the young girl whose family was spearheading charge to loosen medical marijuana restrictions in Virginia had a seizure at the General Assembly. Witnesses said that it was a powerful testament to the need for medical marijuana use in the state.

The mother of the epileptic girl testified that she believes her daughter should be permitted to use medical marijuana. Based on prior experience, cannabis oil has previously alleviated and helped to curb her daughter’s seizures. Like many states where marijuana has not yet been legalized for medical use, parents and patients are becoming impatient with legislators who are resistant to changing state laws.

Though pot is not generally considered dangerous or deadly, there have been an increasing number of 911 and poison control calls in states where marijuana has been legalized.

According to the Associated Press, poison-control centers in Washington and Colorado have seen a spike in the number of calls related to marijuana. The rise is also significant in comparison to other states who have not legalized marijuana and marijuana products for recreational use.

One of the greatest concerns for public health officials is the increase in poison calls involving injury to young children.

The uptick in calls may not have as much to do with more injury risks, but rather, legalization has made parents and caretakers more likely to call in when there is a risk of harm. While there could be an increase in access to marijuana products, including edibles, some say that the spike in poison control calls has more to do with an ease in contacting authorities regarding marijuana.

According to data presented before the Colorado legislature, the Rocky Mountain Poison and Drug Center received 151 calls related to exposure in 2014. The number of calls was up from 88 in 2012, raising concerns for a number of public health professionals.

As states are decriminalizing marijuana possession and sales and making recreational use legal, it is important to remember marijuana sale and cultivation is still a federal offense.

Drug crimes continue to be prosecuted and defendants are still being sent off to prison for conspiracy and distribution being investigated in Colorado, Washington and Colorado. According to recent news reports, three defendants were sentenced to federal prison for their role in a drug trafficking conspiracy that shipped high-grade marijuana from Colorado and California to Cedar Rapids, Iowa.

The Drug Enforcement Agency brought down the investigation through wiretaps and an ongoing investigation. Since charges were filed, all 12 co-conspirators have plead guilty and have received sentences. According to court documents, the defendants financed trips from Colorado and California to traffic the marijuana. One of the growers and co-conspirators had an operation in Breckenridge and the others were profiting from the transport, purchase, and resale of marijuana in Iowa. One of the transport involved a 25-pound shipment by private plane from Colorado to the Iowa City airport. The two conspirators involved in this operation were sentenced to two years in federal prison.
